Terms and Conditions

1. Introduction

1.1 This agreement outlines the terms and conditions (hereinafter "these terms") between you, the user of this website (hereinafter "you", "your"), and us, Construction Guidance Ltd (hereinafter "CG", "we", "us" and "our"), the owner of this website located at constructionguidance.co.uk (hereinafter "our website").

1.2 CG provides advice, test application and pass issuance services (hereinafter "our services") to obtain Construction Skills Certification Scheme (hereinafter "CSCS") and Construction Industry Training Board (hereinafter "CITB") qualifications for all persons wishing to work on a construction site. CG explicitly states it is not part of, nor officially representative of, the CSCS or the CITB.

1.3 Unless the context otherwise admits words importing one gender shall include all other genders and words importing the singular shall include the plural and vice versa.

1.4 Reference to any statutory provisions in this agreement shall include any statutory provision that amends or replaces it.

1.5 You must be a minimum age of 16 to register and make use of this website and any service contained within.

1.6 Your use of this website and any service contained within constitutes acceptance of these terms in full. If you do not agree to be bound by these terms, you should stop using our website immediately.

1.7 Construction Guidance is a booking agent that works exclusively with the constructions industry. Construction Guidance is not part of CSCS or CITB.

2. Services

2.1 Our service is provided “as is” and on an “as available” basis. We give no warranty that the service will be free of defects and/or faults. To the maximum extent permitted by law we provide no warranties (express or implied) of fitness for a particular purpose, accuracy of information, compatibility and satisfactory quality.

2.2 Provision of our services shall commence when full payment has been received or as otherwise detailed within this agreement, pertaining directly to those services.

2.3 No contract shall be formed until you have successfully made payment and received written confirmation from us by email.

2.4 In the event that any of our services are not in conformity with your order and thus incorrect, you should contact us by email at accounts@constructionguidance.co.uk within 7 days to inform us of the error. We will ensure that any necessary corrections to the services provided are made within 14 working days.

2.5 We reserve the right to exercise discretion with respect to any alterations to our services or the provision of those services. Factors which may be taken into account in the exercise of this discretion include, but are not limited to:

2.5.1 Any use that you may have already derived from the services.

2.5.2 Any characteristic of our services, which may mean that cessation of provision, is impossible without significant further work on our part and at our expense. Such discretion will be exercised only within the confines of the law.

3. Pricing

3.1 All pricing information on our website is correct at the time of going online. We reserve the right to change prices and alter or remove any special offers from time to time, as necessary.

3.2 In the event that prices change during the period between an order being placed for our services and the commencement of provision of our services you will be charged the original price at the time you placed your order.

3.3 All prices are inclusive of VAT at the applicable rate.

4. Order process and delivery

4.1 By submitting your order with us and completing the booking, including payment, you are consequently providing your authority to us to begin providing our service with immediate effect.

4.2 Once you have successfully completed the order form, online via our website or verbally with us via telephone, and made payment, we will begin processing your order. Note that orders made verbally via telephone are recorded. If you do not immediately receive confirmation from us that your order is being processed, this does not mean we have not already begun to process your order.

4.3 Once we have received all required information and documentation from you we will submit an application for your CSCS card on your behalf. Note that CSCS card applications need to be submitted within 30 days of the completion of the test. If not, your CSCS card application will be invalid and you will need to begin the process again.

4.4 CSCS cards are not issued automatically. You must email us after completing your CSCS test to provide us with your test results and any other relevant documents. You will be given clear instructions about the documents you must provide.

4.5 CITB does not issue CSCS cards directly. Your CSCS card is sent by CSCS via Royal Mail and delivery is generally within 5-10 working days.

5. Order cancellations and refunds

5.1 We reserve the right to cancel your order for any reason, and without stating that reason, prior to processing payment or commencing our service to you. If an order or payment is cancelled for any reason by us, prior to the commencement of our services provision you will be refunded any monies paid in relation to those purchases, services, pricing and availability. This provision does not affect your other statutory rights as a consumer.

5.2 Once you have completed the order form on our website or verbally with us via telephone and made payment your order cannot be cancelled and/or refunded.

5.3 If we have made an error in processing your order we will attempt to rectify it. If we are unable to rectify it we will refund our service fee to you.

5.4 We may, in special circumstances and at our sole discretion, agree to grant you a refund.

5.5 All refunds incur a £15.00 administration fee. Refunds are applied to the bank account you used to make payment and are processed within 10 working days from the date we agree to, or take the decision to, grant you a refund.

5.6 To request a refund please email us at accounts@constructionguidance.co.uk. We aim to respond to all enquiries within 2 working days.

6. Test cancellations and rescheduling

6.1 If the test centre experiences a problem outside their control, or for any other reason, you will be offered an alternative test date. The test centre also reserves the right to cancel your scheduled test date at any time up to and including the day of your test. The test centre may also terminate your order (without liability to you) if you are in material breach of any of these conditions.

6.2 If you wish to reschedule your test date you must email us at accounts@constructionguidance.co.uk within 5 working days before the scheduled test date and time to reschedule your test. If you do not contact us within 5 working days before the scheduled test date, rescheduling your test will not be possible. A £10.00 administration fee will be charged to reschedule and confirm your new test date.

7. Pass issuance and cancellation

7.1 We are not responsible for the granting of test pass certification and all associated services. We do not issue test pass certification or documentation and accept no responsibility should you fail to be issued or fail to receive your pass certification, CSCS card or any training documentation or correspondence from an awarding body or provider.

7.2 Once an order for a CSCS card has been submitted, it cannot be amended, cancelled or refunded under any circumstances.

8. General responsibilities and ownership

8.1 Whilst every effort has been made to ensure that all descriptions of services available from us correspond to the actual services, we are not responsible for any variations from these descriptions. This does not exclude our liability for mistakes due to negligence on our part and refers only to variations of the correct services, not different services altogether.

8.2 You are solely responsible for the information you submit to us and for conforming to all legal requirements. We are not responsible, under any circumstances, if you do not supply us with correct documentation in a timely manner and as requested, are not eligible to attend a test centre, fail to attend the test centre at the appointed time, fail to complete your test or fail your test.

8.3 Either CG or you may terminate your account. If we terminate your account, you will be notified by email and an explanation for the termination will be provided. Notwithstanding the foregoing, we reserve the right to terminate your account without giving any reasons. If we terminate your account, any current or pending orders or payments on your account will not be cancelled and provision of services will commence.

9. Website linking

9.1 Our website may contain links to other sites. Unless expressly stated, these sites are not under control of CG or that of our affiliates. We assume no responsibility for the content use of them. The inclusion of a link to another site on this website does not imply any endorsement of the sites themselves or those in control of them.

9.2 If you wish to place a link to our website on another website you may do so without our express prior permission to place a link to the homepage only, namely, https://www.constructionguidance.co.uk/.

9.3 Deep linking, for example, links to specific pages within the site, requires our express prior permission.

9.4 To request deep linking permission email us at accounts@constructionguidance.co.uk. We aim to respond to all enquiries within 2 working days.

10. Intellectual property

10.1 Content published on our website, unless provided by you, including, but not limited to, text, graphics, logos, icons, images, sound clips, data compilations, page layout, underlying code and software is the property of CG, our affiliates or other relevant third parties. By continuing to use our website you acknowledge that such material is protected by England and Wales law, international intellectual property laws and any other applicable laws.

10.2 Unless otherwise expressly indicated, all third party intellectual property rights including, but not limited to, copyrighted trademarks, product images and product descriptions belong to the third party manufacturers or distributors of such products as may be applicable.

10.3 You may not reproduce, copy, distribute, store or in any other fashion re-use such material unless otherwise indicated on our website or unless you are given express written permission to do so by the relevant manufacturer or supplier.

11. Privacy and security

11.1 We take your privacy seriously. We are registered under and comply with the Data Protection Act

11.2 Whilst we use reasonable endeavours to ensure that our website is secure and free of errors, viruses and other malware, you are advised to take responsibility for your own security, including your personal details and the computer/s you use to access our website.

12. Limitation of liability

12.1 To the maximum extent permitted by law, we accept no liability for any direct or indirect loss or damage, foreseeable or otherwise, including any indirect, consequential, special or exemplary damages arising from the use of our website or any information contained therein. Your use of our website or any information contained therein is at your own risk.

12.2 We accept no liability for any disruption or non-availability of our website resulting from external causes including, but not limited to, ISP equipment failure, host equipment failure, host equipment failure, communications network failure, power failure, acts of war, natural events or legal restrictions and censorship.

12.3 Neither CG nor this website are affiliated or associated with any official entities or any official body, trade or organisation.

12.4 We make no warranty or representation that our website will meet your requirements, that it will be of satisfactory quality, that it will be fit for a particular purpose, that it will not infringe the rights of third parties, that it will be compatible with all systems, that it will be secure and that all information provided will be accurate. We make no guarantee of any specific results from the use of our service.

12.5 No part of this website is intended to constitute advice and the content of this website should not be relied upon when making any decisions or taking any action of any kind.

12.6 No part of this website is intended to constitute a contractual offer cable of acceptance.

13. Changes to our terms

13.1 In the event of any conflict between these terms and any prior versions thereof, the provisions of these terms shall prevail unless it is expressly stated otherwise.

13.2 We reserve the right to change our website, its content and/or these terms at any time. You will be bound by any changes to the terms from the first time you use our website following the changes. If we are required to make any changes to these terms by law, these will apply automatically to any orders currently pending in addition to any orders placed by you in the future.

14. No waiver

14.1 In the event that any party to these terms fails to exercise any right or remedy contained herein, this shall not be construed as a waiver of that right or remedy.

15. Third party rights

15.1 Nothing in these terms shall confer any rights upon any third party.

16. Law and jurisdiction

16.1 These terms shall be interpreted, construed and enforced in accordance with English law and shall be subject to the exclusive jurisdiction of the English Courts.

16.2 Whilst every effort has been made to ensure that these terms adhere strictly with the relevant provisions of the unfair Contract terms 1977, in the event that any of these terms are found to be unlawful, invalid or otherwise unenforceable, that term is to be deemed severed from these terms and shall not affect the validity and enforceability of the remaining terms. This term shall apply only within jurisdictions where a particular term is illegal.
